BGH decides: Microsoft loses suit against German patent – IT giant faces penalty payment in the millions

Munich, 31st November, 2021. On October 7th, 2021, the Federal Court of Justice in Karlsruhe made a long-awaited decision, and now the written verdict is available: Zoe Life Technologies AG (a company of the Patentpool Group) was fully victorious in the nullity action against Microsoft. In patent law, an action for revocation is an action against a patent owner for (partial) revocation of his patent. The highest court thus ruled that the patent attacked by Microsoft Deutschland GmbH is valid in Germany and can be maintained to the extent granted. Zoe Life Technologies AG is a research company of the Patentpool Group, whose technology is used, for example, for transaction and sentiment analysis or for security-relevant software.
